Policy for Supply of Products

ABOUT US

The website 4babies.co.nz is operated by Motherbase (NZ) Limited. Registered in New Zealand under company number 6257762, we are a limited liability company.

Our company is located in New Zealand but we ship orders both domestically (within New Zealand) and also internationally.

CONDITIONS OF SUPPLY OF GOODS

These Policies for Supply of Products along with our Terms and Conditions and all other documents which are part of our Terms and Conditions will be applicable to any contract between us in relation to the supplying or selling of any merchandise, products or goods  to you. We would recommend that you keep a printout of all relevant documents with you for future use.

When you order any products from us, you agree to be bound by our Terms and Conditions which can be amended from time to time.

We would request you read these Terms and Conditions thoroughly and also ensure that you understand them before offering any products, as they will apply to your order. In case you refuse to accept our terms, you will not be able to order any products from us.

PROCESS INVOLVED IN FORMING THE CONTRACT BETWEEN YOU AND US:

You will get a proper guidance about the steps that you need to follow to order a product from us in our shopping pages . It is essential for you to provide all required data. Our Order Process enables you to thoroughly check and modify any errors before you submit your order to us. We request you to take enough time to read and check your order at every single step of the Order Process before placing an order.

Once you have placed your order, you will receive an e-mail from us with our acknowledgement of the receipt of your order. However, you should note that this does not signify that your order has been accepted. Our acceptance of your order will only happen as described in clause 3.3.

We will send you an e-mail to confirm our acceptance of your order and information about how we will dispatch your products (“Dispatch Information”).  Only after we send you the Dispatch Information, will the contract between you and us for the Products be formed.

It will completely be in our discretion to reject any order that you have placed. If we do not choose to accept your order for any product (maybe because the product is out of stock, not available anymore, because we cannot provide the product within your requested delivery date or because of an error in the price on our site or for any other reason), we will keep you informed over e-mail and we will not process your order. In case you have already paid for the product, we will make it our foremost priority to refund the full amount along with the delivery charges, if any. As a seller, we will no longer have any liability to the buyer in relation to the rejected part of that order.

All the orders will be subject to the availability of the products. We have the full right to revise our range of products or the product specifications without giving you any prior notice.

We are completely entitled at any point and time to rectify any mistakes and omissions (whether it is clerical, computational or otherwise) in any of our invoices, quotations, advertisements or acknowledgements. The mistakes can also discovered after 30 days of delivery of the goods to you due to our administrative process. Once we discover any mistake or omission, we will immediately notify you and provide you with an option of returning the products for a full refund.

Whenever you attempt to verify or cancel any product, this will have no effect unless accepted by us in writing. In cases where we accept your cancellation, we may levy a handling charge of 15% of the applicable purchase price.

OUR RIGHT TO CHANGE THESE TERMS

Whenever you order any product from us, the Terms and Conditions which are applicable at the time of your order will apply to the Contract that we have with you, but we may revise these Terms and Conditions as they apply to any existing order that you have already placed with us, in the following circumstances:

In case we have to make modifications of our existing Terms and Conditions as they are applicable to an existing order from you, we will get in touch with you to provide you a reasonable advance notification of the modifications and also let you know the process to cancel the contract if you are not satisfied with the changes. You can go ahead and cancel the Contract either in respect of the Products that you have ordered or just the products that you are yet to receive. If you choose to cancel your Product, then you would have to return any relevant Products you have received already and we will make arrangements for a full refund of the price that you have paid inclusive of any delivery charges.

PRODUCT DELIVERY

We will contact you with an estimated date of delivery after we have received confirmed acceptance of your order.

In case your Contract is affected by an event outside our control for more than 30 days, you may cancel the Contract. Please contact us in order to cancel. In case you decide to cancel, you will have to return any relevant products which you have received already and we will process a full refund of the total price you have paid including any delivery charges.

When we deliver the products to the address you provide us, delivery of the Order will deemed to be completed and the Product will be your responsibility from that time. We will not be responsible and liable for any order that is delivered in accordance with the delivery instructions you provided.

You are completely responsible for assuring that your order is compliant with all applicable laws and regulations of the country for which the Products are destined. We will not be responsible or liable if you break any such law or regulation.

It is solely your responsibility to pay any import duties, fees, taxes or any other charges which are payable in relation to your order.

If you order any products from our site which need to delivered to one of the international delivery destinations, your order can be subject to necessary import duties and taxes which will be applicable once the product reached that destination. You will be completely responsible for payment of any such import duties and taxes. You are requested to contact your local customs office for more information before you place your order. You should also note that New Zealand law requires all international packages to have all attached customs documentation which describes in detail all the goods that are being sent and their cost.

It will be our foremost endeavour to dispatch your order within the time frame specified for that particular product. If we are not able to dispatch your order within the time frame specified, in that case we will contact you and notify you about the expected delivery date. Any details in relation to delivery times that we make are totally done on good faith but are estimates and we shall not, in any case be bound by such details and we will not be liable or responsible for any damage, loss, expense caused by delay in delivery.

We reserve the complete right to dispatch your order in a single delivery or by instalments. In case of failure to deliver any instalment, you shall not be entitled to repudiate the contract to any instalments that are already delivered. You can cancel any undelivered instalments before a time that the instalment is confirmed.

You will be the owner of the Products only after we have received payment in full and inclusive of all delivery charges.

Our responsibility or liability in relation to the shortages in the quantity of goods delivered is limited only to making up for any such shortages. In cases where you believe that there is a shortage in the quantity of products delivered, you must notify us of any such claim within 7 days of the delivery of the products and must also provide us with a reasonable opportunity to investigate any such claim.

All orders that are delivered within New Zealand have an insurance up to NZ$ 1500 against any damage or loss during transit. All the orders that are delivered through the New Zealand Post International Air Service are insured up to the value of NZ$ 250 against any damage or loss, and you also have an option of purchasing an additional insurance cover up to the value of NZ$ 15000. We will not accept any responsibility for loss or damage in transit that is in excess of the value of loss or damage insurance applicable to that specific delivery.

It will be our responsibility to ensure that products leaving our premises are packed adequately. Any claims of damage or loss in transit must be made against the carrier in the manner prescribed.

You must make sure that the complete consignment in accordance with the carrier’s note has been received, before you acknowledge delivery to carrier. If there is any visible damage to the external package or shortage, the carrier’s note must be accordingly endorsed.

Within 7 days of receiving the consignment, you should ensure that all goods received are in proper condition and order. After 7 days of receipt of goods, no claims of damage will be put into consideration. Whereas we will not be liable or responsible for any goods damaged or lost in transit, yet details of any such claims should be advised to us.

On certain occasions, our delivery to you may be affected by an Event Outside Our Control (as specified in general Terms). Refer to General Terms for knowing our responsibilities if this happens.
